Welcome to Babysitter Connections! This agreement describes your responsibilities and limits our liability, among other things. Please read it carefully before submitting a registration form or using the BabysitterConnections.Com website (the “Site”). It is a condition of registration and use that you agree and are subject to these terms. If you breach any of the terms, your authorization to use this Site automatically terminates.

1. What is Babysitter Connections?

   BabysitterConnections.Com is a publicly accessible internet job posting site which joins Parents seeking babysitters (“Sitters”) and/or Sitters seeking to provide childcare services to Parents. I understand that BabysitterConnections.Com is not involved in the actual transactions between Sitters and Parents, does not schedule meetings between Parents and Sitters, and has no control over the quality or legality of the job listings or job profiles that are posted, the truth or accuracy of the listings, or the actions of the Parents or Sitters.

   BABYSITTERCONNECTIONS.COM IS AN INTERNET JOB POSTING SITE NOT A REFERRAL SERVICE. BABYSITTERCONNECTIONS.COM DOES NOT INTERVIEW, SCREEN, OR PERFORM BACKGROUND CHECKS ON PARENTS OR SITTERS.

   As a parent, I acknowledge that any decision I make to hire a babysitter is my sole decision. I acknowledge that there are inherent risks associated with hiring a babysitter through an internet job posting site and I indemnify and hold Babysitter Connections harmless for any choice I make.

   As a babysitter, I acknowledge that any decision I make with a particular family is my sole decision. I acknowledge that there are inherent risks associated with working for an employer found through an internet job posting site and I indemnify and hold Babysitter Connections harmless for any choice I make.

   I understand that once information is posted on BabysitterConnections.Com, Babysitter Connections cannot control how third parties, including Parents or Sitters will use the information. As a result, I understand that there are risks associated dealing with users with whom I come in contact through this Site and I accept those risks. Although all reasonable means are taken to protect personal information, Babysitter Connections is not responsible for any improper use of personal information that is beyond Babysitter Connection’s reasonable control.

   We do not allow other job posting companies, home childcare providers, nanny agencies, or baby-sitting companies to utilize this service. If you are an employer or owner of another job posting company, home childcare provider, nanny agency, or baby-sitting company and register as a parent or as a sitter, you are in breach on a legal contract. Your registration on BabysitterConnections.Com may result in legal action.

2. My Profile or Listing

   I am 18 years or older.

   I am legally entitled to work in the United States.

   I understand that I am solely responsible for any job profiles or job listings that I submit and I agree to only submit information that is true, accurate and current.

   I will not post a job profile or job listing containing inappropriate information such as material that is obscene, defamatory, threatening, harassing, abusive, embarrassing, or otherwise inappropriate including any discriminatory content based on gender, race, sexual orientation, religious affiliation, disability, ethnicity, or family status.

   I will not post confidential third party information, or any sensitive or personal information, unless it is with the owner’s consent.

3. Indemnity

   I agree to indemnify and hold harmless Babysitter Connections, and its affiliates, officers, agents, partners and employees from any and all liability including all claims alleging loss, costs, expenses, damages arising out of my use of this Site.

4. My Password

   I will maintain the confidentiality of my password and username. I agree not to provide any other individual access to Babysitter Connections via my login information.

   I understand that I am fully responsible for all activities that occur under my username and password. I will immediately notify Babysitter Connections of any unauthorized use of either my username or password or any other breach of security and I will ensure that I exit from my account at the end of each session.

5. Termination of Account

   I understand that Babysitter Connections, in its sole discretion, may at any time terminate my access to this Site and any account or password I may have in connection with this Site.

6. Third Party Internet Sites

   This Site contains links to third party websites that are not under the control of Babysitter Connections. I understand that Babysitter Connections provides these links as a convenience only and is not liable for any loss or damage of any sort or responsible for the content or uses of these third party websites.

7. Babysitter Connections Proprietary Rights

   I understand that the Site and any necessary software used in connection with the Site contain proprietary and confidential information that is protected by applicable intellectual property and other laws including copyright law. I will not attempt to decipher, decompile, appropriate, distribute or create derivative works based on the Site or source code of any of the software available on or through the Site.

8. Disclaimers

   I ACKNOWLEDGE THAT ANY USE OF OR RELIANCE ON THIS SITE OR ANY MATERIALS IS COMPLETELY AT MY OWN RISK.

   Babysitter Connections makes no representation or warranty of any kind regarding the Site and/or the Materials, including with respect to the information provided by third party legal and other consultants, all of which are provided on an "AS IS" basis. BABYSITTER CONNECTIONS EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. BABYSITTER CONNECTIONS. DOES NOT WARRANT THAT THIS SITE WILL CONTINUE TO OPERATE, OPERATE WITHOUT INTERRUPTIONS OR THAT IT WILL BE ERROR-FREE.

9. Limitation of Liability

   I AGREE THAT BABYSITTER CONNECTIONS WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION DAMAGES FOR HARM TO BUSINESS, LOSS OF INFORMATION OR PROGRAMS OR DATA, LOSS OF PROFIT, LOSS OF SAVINGS, LOSS OF REVENUE), ARISING FROM OR IN CONNECTION WITH THE USE OF OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, THIS SITE AND THE MATERIALS PROVIDED, EVEN IF BABYSITTER CONNECTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS. In any event, I agree that Babysitter Connections aggregate liability for damages shall be limited to $100. I understand that the limitations of liability and disclaimers in these Terms of Use apply regardless of the form of action.

10. Privacy Policy

    I agree to be bound by the Privacy Policy which explains why my personal information is being collected and how that information will be treated.

11. Refund

    Babysitters use the site for free.

    For Parents, membership sales are final and Babysitter Connections does not offer any refunds. Once Babysitter Connections has received payment, your account is activated and you are granted full access to the database. Paid memberships cannot be put on hold and banked for use at a later date. I understand that if I cancel my account prior to the end of my membership period, BABYSITTER CONNECTIONS WILL NOT PROVIDE A FULL OR PARTIAL REFUND.

12. General

    I understand that Babysitter Connections may need to disclose personal information about me to cooperate with law enforcement authorities or to protect the safety of users on the Site. I consent to the disclosure of all personal information for these purposes. If any court defines any provision of these Terms of Use to be unenforceable, that provision shall be enforced to the maximum extent permissible, and the remainder of the Terms of Use shall continue in full force and effect. I understand that Babysitter Connections reserves the right, at its sole discretion, to modify these Terms of Use, in whole or in part, at any time. My continued use of this Site after any changes to the Terms of Use are posted, means that I accept those changes. Activating “I agree” signifies my acceptance to be bound by these Terms of Use.
